Terms of Service

These Terms of Service ("Terms") govern your use of the rager.live website and related services (the "Service"), operated by Afterdark Live LLC ("we," "us," "Rager"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

Your account

You are responsible for the activity that occurs under your account and for keeping your password secure. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms, abuse the Service, or attempt to manipulate the rewards program.

Acceptable use

You agree not to: (a) submit false or misleading content; (b) automate, scrape, or reverse-engineer the Service without our written permission; (c) attempt to defeat geofencing, check-in verification, or rewards rate limits; (d) interfere with or disrupt the Service; (e) infringe anyone's rights; or (f) use the Service for any unlawful purpose.

Content you submit

You retain ownership of content you submit (photos, comments, ratings, venue/artist requests). By submitting, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content as part of the Service. You represent that you have the rights necessary to grant this license.

Rewards program

Rager points are a promotional feature. Points have no cash value until redeemed through an offered reward. We may change reward availability, point values, and rules at any time. Reversible abuse (duplicate or remote check-ins, rating-farming, bot activity) voids the associated points. Payouts are subject to verification and may be delayed while we confirm legitimacy. Points expire 12 months after the last earning activity.

Third-party services

The Service links to third-party services (venues, ticketing sites, rideshare apps, payment processors). We are not responsible for their content, availability, or practices. Your use of those services is governed by their own terms and policies.

Tickets and events

Rager is a discovery service. We do not sell tickets, produce events, or guarantee that listed shows will occur as described. Ticketing, refunds, and event conduct are between you and the venue or ticketing provider.

Affiliate links and commissions

Some outbound links on the Service — including ticketing partners (such as SeatGeek and Ticketmaster), rideshare partners (such as Uber and Lyft), and certain venue or food-and-beverage partners — are affiliate links. When you click one of these links and complete a qualifying action, we may receive a commission from the partner. You pay no more than you otherwise would; the partner pays us a share of their standard marketing budget. Affiliate relationships do not influence the shows, artists, or venues we surface, and we disclose these relationships in our Privacy Policy and on pages that feature affiliate links, as required by the U.S. Federal Trade Commission's Endorsement Guides (16 C.F.R. Part 255).

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS OR (II) USD $100. WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Termination

You may stop using the Service and delete your account at any time from the Account page. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination will survive.

Changes

We may update these Terms from time to time. If we make material changes, we'll update the effective date and, where appropriate, notify you. Your continued use after changes take effect constitutes acceptance.

Governing law

These Terms are governed by the laws of the State of Florida, excluding its conflicts of law rules. Disputes will be resolved in the state or federal courts located in Hillsborough County, Florida.
